Will a DUI Ever Come off My Record?

DUI records are usually a part of the adult criminal record and a matter of public record. This means that anyone willing to seek out those records can be able to learn about your criminal history. DUI convictions are also regularly found in local newspapers. The question is will a DUI ever come off your records? Read more to seek the answer.

In most of the cases, A DUI conviction can continue to be on your driving record until further notice. However, you can appeal the court to remove a DUI from your record. Make sure you are well aware as the legal process varies by state for clearing a DUI from your driving record.

If the judge declines to grant you a new trial or you drop your second trial then you may be entitled to petition your DUI conviction. If there is a blunder of law at your trial or the board of judges entirely overlooks the facts then you may have justification for an appeal. An appeal engages filing briefs with the court and an oral dispute. However, you will not be needed to be present or participate in the appeal. If your appeal turns out to be successful then your conviction will be inverted and your record will be cleared.

If your appeal turns out to be unsuccessful, then you still have some alternatives. In many states, you may be entitled for an expungement. An expungement is a legal procedure in which, following the passage of an assured amount of time, after your conviction or arrest which is normally one year, your DUI attorneys or DUI lawyers can apply to have your DUI conviction wiped out from your criminal record. However, in most states an expungement is not accessible for an offensive conviction and in many states it is not even accessible for a crime or even for trial.

If you or someone else has been involved in a DUI or if you have been arrested or charged for a drunk driving offense, simply don’t wait for any miracle to happen or keep on wondering will a DUI ever come off my record. If you do, you could endanger the precious legal rights.

Ann Arbor DUI Lawyer

The truth is if you are looking for an Ann Arbor DUI lawyer, you have options .  It seems as if the amount of DUI lawyers in Ann Arbor have significantly increased.  Part of the reason for the increase in Ann Arbor DUI Lawyers is due to economic problems which are causing many Ann Arbor lawyers who may not usually handle DUIs to take whatever case they want.  Just like you wouldn’t want a dermatologist determining whether or not you have a broken bone, you don’t want a divorce lawyer handling your DUI case.  Here are some tips in choosing the right Ann Arbor DUI lawyer:

1. Is your Ann Arbor DUI Lawyer too busy to handle your case?

This is rather easy to determine. How long does it take for your Ann Arbor Lawyer to call you back when you have a question?  Does he often forget to call you at all? When you meet with him in person, is he often stopping the conversation to answer his cell phone? Perhaps your Ann Arbor DUI Lawyer doesn’t even have time to meet with you.

2. Does your Ann Arbor DUI Lawyer do Criminal Law (or DUIs)?

You may be thinking, of course my Ann Arbor DUI Lawyer does criminal law, he wants to do my case! This may not be correct. The recession hit Ann Arbor DUI lawyers just as hard as everyone else.  The result is that many lawyers have had to expand their practice past what they traditionally do. The easiest way to make sure that your lawyer does do criminal law is simply to ask him what percentage of his cases are criminal.

3. Does your Ann Arbor DUI  Lawyer tell you about the fees upfront?

Michigan Legal Ethics require that your Ann Arbor DUI Lawyer be upfront about all costs associated with your representation.  Unlike other types of law, it is more common that in there is an upfront fee associated with your DUI case.  The only extras outside of this fee should be out of pocket costs associated with your representation (IE copies of the police report, etc.).  Your Ann Arbor DUI Lawyer should have you sign a written agreement that states in plain english how he will represent you.

Ultimately finding a quality Ann Arbor DUI Lawyer is about finding the attorney that you are comfortable working with.  DUI’s are a big deal and often have serious consequences.  You need an Ann Arbor DUI Lawyer you can trust.
